2009 Federal Witness Fees Decrease
On November 25, 2008 the Internal Revenue Service issued a standard-mileage-reimbursement rate used to calculate the deductible costs of operating an automobile for business.

The change affects the federal witness fee in 2009 by the decreasing the mileage rate to $.55 per mile from $.58 per mile in effect from July 1, 2008 through December 31, 2008.

The rate affects the federal witness fee calculation, adding $.55 cents per mile to the per diem (per day) fee of $40.00. That rate is calculated from the witness' residence to the place of appearance. This mileage fee is cross-referenced to 18 USC § 1821 and 5 USC § 5704, the laws governing reimbursement to governmental workers and adopted by the General Services Administration.
